Abstract:

“Penelitian ini adalah untuk mengetahui dan mengkaji penegakan hukum terhadap pelaksanaan eksekusi putusan sengketa keterbukaan informasi publik dalam Nomor Perkara 395 K/TUN/KI/2021 terhadap Standar Operasional Prosedur Permohonan Eksekusi di PTUN Surabaya. Metode penelitian yang digunakan ialah penelitian hukum empiris melalui pendekatan kualitatif. Hasil penelitian menujukkan bahwa permohonan eksekusi yang diajukan oleh Pemohon Informasi dalam Perkara 395 K/TUN/KI/2021 beberapa hal terjadi ketidaksesuaian dengan SOP/028-029/PRK/2018 tentang permohonan eksekusi namun dari ketidaksesuain tersebut nyatanya tetap memberikan keadilan, kemanfaatan, dan kepastian hukum bagi para pihak. This study aims to determine and analyze the law enforcement of the execution of a decision on a dispute over public information disclosure in Case Number 395 K/TUN/KI/2021 against the Standard Operating Procedure for Requests for Execution at the Surabaya State Administrative Court. The research method used is empirical legal research through a field kualitatif. The results of the study show that the request for execution submitted by the Information Applicant in Case 395 K/TUN/KI/2021 does not comply with SOP/028- 029/PRK/2018 regarding requests for execution, but from these discrepancies, in fact, it still provides justice, benefits, and legal certainty for the parties.”
