Abstract:

“Penelitian ini bertujuan untuk mengetahui peran serikat pekerja atau serikat buruh dalam pemenuhan hak pekerja penyandang disabilitas, berdasarkan Undang-Undang Nomor 21 Tahun 2000 tentang Serikat Pekerja/Serikat Buruh. Metode yang digunakan dalam penelitian ini yakni metode yuridis normatif. Dimana metode yuridis normatif merupakan metode yang mengkaji tulisan berdasarkan doktrin-doktrin atau asas-asas dalam ilmu hukum. Hasil penelitian menunjukan pada hukum positif Indonesia telah memberikan kedudukan terhadap pekerja disabilitas yang mana hak-hak tersebut berlaku sama terhadap seluruh pekerja termasuk kaum penyandang disabilitas. Peran serikat pekerja atau buruh telah sesuai dengan ketentuan yang berlaku saat ini, namun dalam pemenuhan hak pekerja penyandang disabilitas serikat pekerja atau buruh berdasarkan penelitian ini diketahui bahwa pengaturan saat ini belum memuat terkait pemenuhan hak para buruh dengan disabilitas, hal tersebut disebabkan pelanggaran hukum yang ada masih banyak perusahaan enggan menerima pekerja penyandang disabilitas. ABSTRACT This study aims to determine the role of trade unions or labor unions in fulfilling the rights of workers with disabilities, based on Law Number 21 of 2000 concerning Trade Unions/Labor Unions. The method used in this research is the normative juridical approach. The normative juridical method is a method that examines writing based on doctrines or principles in legal science. The results showed that Indonesian positive law has given a position to workers with disabilities where these rights apply equally to all workers including people with disabilities. The role of trade unions or laborers is in accordance with the current provisions, but in fulfilling the rights of workers with disabilities trade unions or laborers based on this research it is known that the current arrangements do not yet contain the fulfillment of the rights of workers with disabilities, this is due to violations of existing laws that many companies are still reluctant to accept workers with disabilities.”
