Abstract:

“Tujuan dari penelitian ini adalah untuk menganalisis dan mengidentifikasi upaya hukum bagi pihak yang dirugikan oleh seorang Notaris. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan hukum primer terutama mengenai peraturan perundang-undangan Undang-Undang Tentang Jabatan Notaris Dalam penelitian ini data dikumpulkan melalui studi terhadap dokumen dan studi kepustakaan. Upaya hukum terhadap pelanggaran atau kesalahan yang dilakukan oleh notaris yang dapat merugikan pihak lain dapat dilakukan sesuai dengan jenis pelanggaran/kesalahan yang diduga dilakukan oleh notaris. Melaporkan ke Majelis Pengawas Daerah, Digugat secara Perdata. Dilaporkan secara Pidana Selain melaporkan kepada Majelis Pengawas Daerah dan menggugat secara perdata, pihak yang dirugikan dapat melaporkan secara pidana. The purpose of this study is to analyze and identify legal remedies for parties who are harmed by a Notary. This study uses a normative juridical approach, using primary law, especially regarding laws and regulations concerning the Office of Notaries. In this study, data were collected through a study of documents and literature. Legal remedies for violations or mistakes made by a notary that can harm other parties can be carried out according to the type of violation/error allegedly committed by the notary. Reported to the Regional Supervisory Board, civilly sued. Reported Criminally In addition to reporting to the Regional Supervisory Board and suing in a civil manner, the aggrieved party can report criminally.”
