Abstract:

“Pada artikel ini akan dipaparkan sekelumit tentang jejak-jejak artefak norma tentang tindak pidana pelecehan seksual dalam Kitab Undang-Undang Tanjung Tanah dan Undang-Undang Simbur Cahaya. Undang-Undang Tanjung Tanah yang ditemukan di kawasan Kerinci, Jambi, merupakan salah satu naskah tertua, karena ditulis sekitar abad XIV dengan segala pola perumusan dalam rangka kodifikasi norma hukum di masa lalu. Selain itu, artikel ini juga menyajikan jejak-jejak norma dalam UU Penerangan. Analisis disajikan dalam disiplin ilmu filologi. Teks-teks yang dihadirkan oleh para filolog dapat menggambarkan jejak artefak normatif mengenai kejahatan seksual di masa lalu. Artikel ini menyimpulkan bahwa sanksi pidana untuk kejahatan seksual dalam UU Tanjung Tanah lebih berat, bahkan hingga hukuman mati. Dalam Undang-Undang Simbur Cahaya, tindak pidana kekerasan seksual lebih merupakan sanksi administratif dengan denda tertentu. This article presents the traces of the norm artifacts regarding the crime of sexual harrasment in the Tanjung Tanah Law and the Simbur Cahaya Law. The Tanjung Tanah Law, which was found in the Kerinci area, Jambi, is one of the oldest manuscripts because it was written around the XIV century with all patterns of formulation in the context of codifying legal norms in the past. In addition, this article also explains a bit about the traces of norms in the Act of Lighting. In the method of presenting the text editions of the Tanjung Tanah Law and the Simbur Cahaya Law, the discipline of philology is used. The texts presented by philologists can illustrate traces of normative artifacts regarding sexual crimes in the past. Criminal sanctions for sexual crimes in the Tanjung Tanah Law are more severe, even up to the death penalty. In the Simbur Cahaya Act, the crime of sexual violence is more of an administrative sanction with a specified fine.”
