PERLINDUNGAN HUKUM TERHADAP KONSUMEN AKIBAT BURUKNYA KUALITAS PRODUK PANTYLINER MILIK SALAH SATU PERUSAHAAN INDONESIA

Abstract:
“Penulisan artikel ini bertujuan untuk mengetahui dan menganalisis mengenai perlindungan hukum terhadap konsumen akibat buruknya kualitas pantyliner milik salah satu perusahaan Indonesia, serta tanggung jawab pelaku usaha terhadap konsumen akibat terbukti produk pantyliner miliknya berkualitas buruk. Metode penelitian dalam penulisan artikel ini menggunakan metode penelitian hukum secara normatif serta pendekatan perundang-undangan. Hasil penulisan pada artikel ini berkesimpulan bahwa produk pantyliner milik salah satu perusahaan Indonesia terbukti memiliki kualitas buruk akibat tidak sesuai dengan perundangan-undangan di Indonesia, yang selanjutnya berimplikasi dilanggarnya hak-hak konsumen. Sehingga sebagai pengguna produk, maka konsumen berhak mendapatkan perlindungan hukum yaitu pada Peraturan Menteri Kesehatan 472/Menkes/Per/V/1996, Pasal 41 Peraturan Menteri Kesehatan 62/2017, Pasal 3 Peraturan Pemerintahan 102/2000, Pasal 7 ayat (1) Peraturan Menteri Kesehatan 96/Men.Kes/Per/v/1977 dan Pasal 4, 7, 8 ayat (1) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Selanjutnya, menuntut pertanggungjawaban hukum terhadap pelaku usaha yang tertuang jelas dalam Pasal 19, 22, 23 dan 28 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Adanya regulasi hukum ini memberikan keuntungan yaitu tercapainya perlindungan kepentingan dari kedua belah pihak (pelaku usaha dan konsumen) baik berbentuk hukum atau non-hukum secara seimbang. ABSTRACT The purpose of writing this article to find out and analyze of legal protection of consumers due to poor quality of pantyliner owned by an Indonesian company, and the responsibility of business actors to consumers due to the fact that their pantyliner products are of poor quality. The research method in writing this article uses a normative legal research method and statue approach. The result of research in this article indicate that pantyliner products belonging to an Indonesia company is proven to have poor quality due to notaccordance with the regulation in Indonesia, which further implications for the violation of consumer rights. So as a user of the product, the consumers are entitled to get legal protection is in the Regulation of the Minister of Health 472/Menkes/Per/V/1996, Article 41 of Regulation of the Minister of Health 62/2017, Article 3 of Government Regulation 102/2000 and Article 7 paragraph (1) of Regulation of the Minister of Health 96/Men.Kes/Per/v/1977, and Articles 4, 7, 8 paragraph (1) of Law 8 Number 8 of 1999 concerning Consumer Protection. Furthermore, demand legal responsibility to business actors which are clearly stated in Articles 19, 22, 23 and 28 of Law Number 8 of 1999 concerning Consumer Protection. The existence of this legal regulation provides an advantages the achievement of the protection of interests from both parties (business actors and consumers) in the form of legal or non-legal a balanced manner.”
