Abstract:
“Tujuan studi ini untuk menelaah perlindungan hukum bagi konsumen ditengah maraknya pengedaran smartphone black market yang salah satunya bermerek iPhone sebagai merek yang diminati masyarakat. Studi ini menggunakan penelitian hukum normatif dengan metode deskriptif yang diulas lebih lanjut dengan pendekatan perundang-undangan serta pendekatan analisis. Hasil studi menunjukkan bahwa perlindungan konsumen tepatnya tentang terjaminnya hak-hak konsumen diatur dalam Pasal 4 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Proses penegakan sengketa konsumen juga diatur dalam Pasal 45 Bab X tentang Penyelesaian Sengketa pada undang-undang a quo. Dalam perspektif prelindungan konsumen, mendapatkan informasi yang benar, jelas, dan jujur mengenai kondisi dan jaminan barang dan/atau jasa yang dijual oleh pelaku usaha serta mendapatkan kompensasi atau ganti rugi atas produk yang tidak sesuai merupakan pemenuhan hak-hak sebagai konsumen. The purpose of this study is to examine the legal protection for consumers in the midst of the widespread circulation of black market smartphones, one of which is branded iPhone as a brand that is in demand by the public. This study uses normative legal research with a descriptive method which is further reviewed with a statutory approach and an analytical approach. The results of the study show that consumer protection is precisely about ensuring consumer rights as regulated in Article 4 of Law Number 8 of 1999 concerning Consumer Protection. The consumer dispute enforcement process is also regulated in Article 45 Chapter X concerning Dispute Resolution in the law. In the perspective of consumer protection, obtaining correct, clear, and honest information regarding the conditions and guarantees of goods and/or services sold by business actors as well as obtaining compensation or compensation for products that are not in accordance with the fulfillment of rights as consumers.”
