Abstract:
“Tujuan dari penelitian ini adalah agar faktor penyebab terjadinya kebocoran data konsumen e-commerce dan bagaimana perlindungan hukumnya dapat diketahui. Penelitian ini menggunakan metode hukum normatif yang menginvestigasi makalah, literatur, ataupun peraturan perundang-undangan yang berkorelasi dengan substansi yang diteliti. Hasil dari penelitian ini adalah penyebab terjadinya kebocoran data konsumen disebabkan oleh para pemilik jasa yang lebih memperhatikan fitur-fiturnya daripada securitynya hingga terjadi bug (celah) yang dapat menyebabkan eksploitasi untuk pencurian data konsumen e-commerce dan perlindungannya diatur dalam Pasal 30 dan 46 UU ITE. Tetapi hal itu belum cukup untuk memberikan perlindungan kepada konsumen e-commerce maka pelu disahkannya rancangan undang undang perlindungan data pribadi oleh pemerintah. The main objective of the current study is to figure out what causes consumer data e-commerce and how legal protection is provided. The normative law approach was used in order to accomplish this scientific paper which evaluates particular paper, literature, or laws and regulations that are suitable to the issues under researched. According to the findings of this study, service providers who pay more attention to their features than security until a bug occurs which can lead to exploitation for consumer data theft of e-commerce customers are responsible for consumer data leakage and consumer data protection is regulated in Articles 30 and 46 of the ITE Law. However, this is incapable of protecting e-commerce clients, so the government should also finalize the personal data protection legislation.”
