PERLINDUNGAN HUKUM BAGI KONSUMEN TERHADAP KETIDAKSESUAIAN KUALITAS BARANG YANG DIBELI PADA APLIKASI BELANJA TIKTOK SHOP

Abstract:
“Penulisan jurnal ini bertujuan memberikan perlindungan hukum terhadap konsumen atas kualitas barang dimana tidak cocok dengan yang dipromosikan pelaku usaha di TikTok Shop serta mengetahui bagaimana penyelesaian yang akan dilakukan kepada pelaku usaha atas kerugian yang konsumen alami terhadap ketidaksesuaian kualitas barang yang dipromosikan di Tiktok Shop. Jurnal ini mempergunakan metode penulisan normatif dimana bersumberkan pada norma-norma hukum seperti peraturan perundang-undangan, putusan pengadilan hingga norma-norma pada masyarakat yang ada dan didasarkan pada pendekatan terhadap peraturan perundang-undangan. Hasil penulisan ini adalah menjelaskan adanya bentuk perlindungan hukum terhadap konsumen yang diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen mengenai ketidaksesuaian kualitas barang yang dibeli dengan yang dipromosikan di Tiktok Shop khususnya pada Pasal 4 huruf c dan h Undang-Undang Perlindungan Konsumen, Pasal 7 huruf b dan f Undang-Undang Perlindungan Konsumen, Pasal 8 ayat (1) huruf f Undang-Undang Perlindungan Konsumen dan terkait penyelesaiannya terhadap kerugian yang konsumen alami diatur pada Pasal 19 Undang-Undang Perlindungan Konsumen yang dimana jika dibandingkan dengan KUHPerdata terdapat perbedaan substansi dalam hal ganti rugi tersebut serta proses penyelesaian kerugian konsumen tersebut dapat dilakukan melalui pengadilan sebagaimana diatur pada Pasal 23 Undang-Undang Perlindungan Konsumen dan juga musyawarah. Kata Kunci: TikTok Shop, Barang, Perlindungan Hukum. Writing this journal aims to provide legal protection to consumers for the quality of goods which do not match those promoted by business actors at TikTok Shop and to find out how the settlement will be made to business actors for the losses that consumers experience against the incompatibility of the quality of goods promoted in TikTok Shop. This journal uses a normative writing method which is based on legal norms such as statutory regulations, court decisions to norms in existing society and is based on an approach to statutory regulations. The result of this paper is to explain the existence of a form of legal protection for consumers regulated in Law Number 8 of 1999 concerning Consumer Protection regarding the incompatibility of the quality of goods purchased with those promoted in Tiktok Shop, especially in Article 4 letters c and h of the UUPK, Article 7 letter b and f UUPK, Article 8 paragraph (1) letter f UUPK and related to the settlement of losses suffered by consumers is regulated in Article 19 UUPK which when compared to the Civil Code there is a difference in substance in terms of compensation and the process of resolving consumer losses can be done through the courts which regulated in Article 23 UUPK and also deliberation.
