Abstract:

“Tujuan penelitian ini untuk menganalisis Persyaratan negara hukum yang dianut Indonesia dan Independensi penegak hukum sebagai syarat terwujudnya negara hukum. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan Persyaratan negara hukum yang dianut Indonesia mengacu pada pendapat Jimly Ashiddiqie setidaknya terdapat dua belas prinsip pokok, yaitu: supremasi hukum; persamaan dalam hukum; asas legalitas; pembatasan kekuasaan; organ-organ eksekutif independen; peradilan yang bebas dan tidak memihak; peradilan tata usaha negara; peradilan tata negara; perlindungan hak asasi manusia; bersifat demokratis; berfungsi sebagai sarana mewujudkan tujuan bernegara; transparansi dan kontrol sosial, dan ditambahkan prinsip ke tiga-belas, yaitu prinsip ber-Ketuhanan Yang Maha Esa; dan Independensi penegak hukum sebagai syarat terwujudnya negara hukum mengacu pada persyaratan Negara hukum yang salah satunya bercirikan peradilan yang bebas dan tidak memihak. Hal ini berarti aparat penegak hukum sebagai komponen dari sistem peradilan pidana harus independen, bebas dari pengaruh pihak manapun termasuk eksklusif. The purpose of this study is to analyze the requirements of the rule of law adopted by Indonesia and the independence of law enforcement as a condition for the realization of a rule of law. The research method used is a normative legal research method. The results of the study show that the requirements of the rule of law adopted by Indonesia refer to Jimly Ashiddiqie’s opinion that there are at least twelve main principles, namely: the rule of law; equality in law; the principle of legality; limitation of power; independent executive organs; an independent and impartial judiciary; state administrative court; constitutional court; protection of human rights; democratic; serves as a means of realizing the goals of the state; transparency and social control, and added a thirteenth principle, namely the principle of believing in one God; and The independence of law enforcement as a condition for the realization of a state of law refers to the requirements of a state of law, one of which is characterized by an independent and impartial judiciary. This means that law enforcement officers as components of the criminal justice system must be independent, free from the influence of any party, including the exclusive.”
