Abstract:

“Tujuan penulisan ini untuk mengkaji kepastian hukum kebijakan pengupahan berkaitan dengan kebijakan upah minimum pada karyawan industry perhotelan selama pandemic covid-19 dan upaya penyelesaian perselisihan hubungan industrial terkait pengupahan. Dalam penelitian ini digunakan metode penelitian normative dengan menggunakan pendekatan peraturan perundang-undngan dan pendekatan konsep hukum. Hasil penelitian menunjukan bahwa penerapan upah minimum merupakan suatu keharusan meskipun adanya ketentuan perubahan besaran dan cara pembayaran dilakukan sesuai dengan kesepakatan antara pengusaha dan pekerja/buruh pada ‘Surat Edararan Menteri Ketenagakerjaan Republik Indonesia Nomor M/3/HK.04/III/2020 Tahun 2020 tentang Perlindungan Pekerja/Buruh dan Kelangsungan Usaha Dalam Rangka Pencegahan dan Penanggulangan Covid-19’. Hasil penelitian juga menunjukan jika terjadi penrselisihan hubungan industrial terkait pengupahan harus diselesaikan melalui perundingan bipatrit, jika tidak berhasil dapat dilakukan mediasi, konsoliasi atau arbitrase, dalam hal hain dapat juga ditempuh jalur litigasi dengan melayangkan gugatan ke pengadilan hubungan industrial. This research aims to review the legal certainty of wage policies related to minimum wage policies on hospitality industry employees during the covid-19 pandemic and efforts to resolve industrial relations disputes related to wages. This research uses normative research methods with a statutory approach and a legal concept approach. The results showed that the implementation of the minimum wage is a must despite the provisions of changes in the amount and way of payment is made in accordance with the agreement between employers and workers / workers in ‘the Circular Letter of the Minister of Manpower of the Republic of Indonesia Number M / 3 / HK.04 / III / 2020 year 2020 on Protection of Workers / Workers and Business Continuity in the Framework of Prevention and Countermeasures of Covid-19’. The results also showed that if there is an industrial relations dispute related to wages must be resolved through bipatrit negotiations, if it is not successful can be done mediation and console or pursue litigation by filing a lawsuit to the industrial relations court.”
