Abstract:
“Tujuan dari penelitian ini ialah untuk mengkaji pertanggungjawaban pelaku usaha atas kerugian konsumen perjanjian baku. Tanggung jawab pelaku terhadap konsumen dipengaruhi oleh status kedua belah pihak perjanjian baku, yaitu status pelaku usaha ialah pihak secara ekonomi kuat dan konsumen ialah pihak secara ekonomi lemah tidak seimbang. Metode penelitian digunakan ialah metode yuridis normatif. Hasil dari penelitian ini ialah kompensasi ditujukan untuk memulihkan keadaan sebelumnya rusak musnah artian akibat ketidakseimbangan penggunaan barang dan jasa tidak memenuhi harapan permintaan. Tanggung jawab ialah kewajiban untuk membuat pihak melanggar wajib menanggung risiko ditimbulkan oleh perilakunya, dan perilakunya dapat dituntut dipersyaratkan untuk dituntut. Konsumen dirugikan berhak mengajukan pengaduan dan berhak menerima ganti rugi dari pelaku usaha, begitu pula sebaliknya. The purpose of this study is to examine the liability of business actors for consumer losses on standard agreements. The responsibility of the actor to the consumer is influenced by the status of the two parties to the standard agreement, namely the status of the business actor is the economically strong party and the consumer is the economically weak and unbalanced party. The research method used is the normative juridical method. The result of this research is that compensation is intended to restore the previously damaged condition, meaning that the imbalance in the use of goods and services does not meet demand expectations. Responsibility is the obligation to make the violating party obliged to bear the risks caused by his behavior, and his behavior can be prosecuted and required to be prosecuted. Aggrieved consumers have the right to file complaints and are entitled to receive compensation from business actors, and vice versa.”
