Abstract:

“Tujuan penulisan yang hendak dicapai yaitu untuk memahami dan mengerti mengenai pengaturan batas waktu penetapan kedaruratan kesehatan masyarakat Corona Virus Disease 2019 (Covid-19). Penelitian ini menggunakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan konsep hukum. Hasil penelitian menunjukkan bahwa pengaturan terkait pemberian kewenangan Presiden dalam menetapkan keadaan darurat nasional di Indonesia yaitu diatur pada Pasal 12 UUD NRI 1945. Berdasarkan Pasal inilah dasar aturan yang memberikan seorang Presiden wewenang untuk menetapkan syarat-syarat dan keadaan bahaya dalam hal ini keadaan darurat, namun tetap hal tersebut tidak dapat dilakukan semena-mena, namun harus berdasarkan Undang-Undang terlebih dahulu. Yang kemudian diturunkan kepada 2 aturan yaitu Perppu Keadaan Bahaya dan UU Penanggulangan Bencana. Pengaturan Batas Waktu Penetapan Kedaruratan Kesehatan Masyarakat Corona Virus Disease 2019 yang diatur pada Keppres Covid-19 tidak mengatur mengenai kapan batas waktu berakhirnya keadaan darurat tersebut. Keppres Covid-19 ini harus mengatur mengenai batas waktu kapan keadaan darurat kesehatan masyarakat ini berakhir, karena dengan tidak diaturnya mengenai batas waktu berakhirnya keadaan darurat tersebut sudah menyalahi Asas Kesementaraan (limitation of time), Kebutuhan untuk mengatur batas waktu darurat diperlukan sehingga semua tindakan hukum jika terjadi keadaan darurat dapat diukur dan dikendalikan dengan baik. The purpose of writing to be achieved is to understand and understand the time limit for determining the Corona Virus Disease 2019 (Covid-19) public health emergency. This study uses normative legal research using a statutory approach and legal concepts. This study shows that the regulations regarding the granting of the President’s authority in determining a national emergency in Indonesia are regulated in Article 12 of the 1945 Constitution of the Republic of Indonesia. Based on this Article, the basic rules give the President the authority to determine the terms and conditions of danger, in this case an emergency, however still this cannot be done arbitrarily, but must be based on law first. This was later revealed to 2 regulations, namely the State of Danger Perppu and the Law on Disaster Management. Setting the Deadline for Determining the Corona Virus Disease 2019 Public Health Emergency which is regulated in the Covid-19 Presidential Decree does not regulate the time limit for the end of the emergency. This Covid-19 Presidential Decree must regulate the time limit for when this public health emergency ends, because by not regulating the time limit for the end of the emergency, it violates the principle of temporaryness (limitation of time), the need to set a time limit for an emergency is required so that all legal action in the event of an emergency can be measured and controlled properly.”
