Abstract:

“Tujuan penelitian ini untuk menganalisis dan mengidentifikasi Perkara Pidana Militer di Indonesia Dalam Perspektif Ius Constitutum. Penelitian ini menggunakan metode pendekatan undang-undang yaitu dilakukan dengan menelaah semua undang-undang dan regulasi yang bersangkut paut dengan penulisan ini, pendekatan konseptual yaitu beranjak dari pandangan-pandangan dan doktrin-doktrin yang berkembang di dalam ilmu hukum dan pendekatan komparatif yaitu dilakukan dengan membandingkan undang-undang suatu negara dengan undang-undang dari satu atau lebih negara lain. Hasil penelitian ini pada pembentukan Jaksa Agung Muda Pidana Militer merupakan sarana atau lembaga penuntutan satu atap yang menghimpun dan mengelaborasikan para Oditur Militer dan Jaksa untuk bersatu padu dalam menangani atau menuntut seorang prajurit atau tentara dalam konteks Hukum Pidana Militer. The purpose of this study is to analyze and identify Military Criminal Cases in Indonesia in the Perspective of Ius Constitutum. This research uses a statutory approach method which is carried out by examining all laws and regulations related to this, a conceptual approach which departs from the views and doctrines that develop in legal science and a comparative approach which is carried out by comparing laws. -the laws of a country with the laws of one or more other countries. The results of this study on the Order of the Junior Attorney General for Military Crimes are a one-stop facility or institution that collects and elaborates military prosecutors and prosecutors to unite in an alliance or sue a soldier or soldier in the context of Military Criminal Law.”
