Abstract:

“Tujuan penelitian artikel ilmiah ini adalah mengkaji perlindungan hukum terkait, terhadap konsumen yang menderita kerugian yang berakibat dalam menggunakan produk kosmetik yang dimana memuat bahan-bahan berbahaya serta pertanggung jawaban hukum dari pelaku usaha terhadap konsumen yang dirasa dirugikan. Metode penulisan penelitian artikel ilmiah ini menggunakan metode penelitian hukum normatif dengan acuan Undang-Undang No. 8 Tahun 1999 Tentang Perlindungan Konsumen. hasil penelitian tersebut menunjukan kesimpulan bahwa pelaku usaha kosmetik dimana pengedarannya memuat bahan-bahan berbahaya, telah melanggar Undang-undang Perlindungan Konsumen diantaranya pasal 4 huruf a, pasal 7 huruf d dan pasal 8 huruf d. Pada pertanggung jawaban pelaku usaha yang mengedarkan kosmetik dengan bahan yang berbahaya diwajibkan untuk bertanggung jawab penuh sesaui dengan ketntuan pasal 19 Undang-undang Perlindungan Konsumen. The purpose of this study is to examine the legal protection of consumers who suffer losses due to using cosmetic products that contain hazardous ingredients and the legal liability of business actors to consumers who suffer losses. The method of this research uses normative legal research methods with reference to Law No. 8 of 1999 concerning Consumer Protection. From the results of this study, it can be concluded that comestics business actors who have distributed which contain hazardous ingredients have violated the Consumer Protection Law, including article 4 letter a, article 7 letter d and article 8 letter d. On the responsibility of business actors who distribute cosmetics with hazardous ingredients are obliged to take full responsibility in accordance with the provisions of article 19 of the Consumer Protection Law.”
