Abstract:

“Tujuan dari penelitian ini adalah untuk mengidentifikasi serta menganalisis terkait perlindungan hukum terhadap hak pekerja perjanjian kerja waktu tertentu dalam pemutusan hubungan kerja sebelum kontrak berakhir dan pertanggungjawaban perusahaan terhadap hak pekerja perjanjian kerja waktu tertentu dalam pemutusan hubungan kerja sebelum kontrak berakhir. Metode penelitian ini menerapkan yuridis normatif dengan menggunakan pendekatan perundang-undangan dan kasus dilengkapi sumber hukum primer, sumber hukum sekunder dan sumber hukum tersier. Hasil pada penelitian ini menunjukkan bahwa perusahaan tidak boleh bertindak sewenang-wenang dengan melakukan pemutusan hubungan kerja sebelum kontrak berakhir dan harus tetap berpedoman terhadap ketentuan hukum yang telah ditetapkan dan pekerja yang terkena pemutusan hubungan kerja sebelum kontrak berakhir berhak mendapatkan perlindungan hukum atas hak uang kompensasi, adapun pertanggungjawaban perusahaan yaitu perusahaan diwajibkan memberikan hak atas uang kompensasi yang besarannya dihitung berdasarkan jangka waktu perjanjian kerja waktu tertentu yang telah dilaksanakan oleh pekerja. The aim of this research is to identify and analyze legal protection for the rights of workers with fixed-term employment agreements in terminating their employment relationship before the contract ends and the company’s responsibility for the rights of workers with fixed-term employment agreements in terminating their employment relationship before the contract ends. This research method applies normative juridical law using a statutory and case approach equipped with primary legal sources, secondary legal sources and tertiary legal sources. The results of this research indicate that companies must not act arbitrarily by terminating employment before the contract ends and must remain guided by the legal provisions that have been established and workers who are terminated before the contract ends are entitled to legal protection for their rights to compensation money. As for the company’s responsibility, the company is required to provide the right to compensation money, the amount of which is calculated based on the terms of a certain work agreement that has been implemented by the worker.”
