Abstract:

“Penelitian ini bertujuan untuk membandingkan hukum kontrak, khususnya dalam penentuan ganti kerugian akibat wanprestasi, di Indonesia dan Australia sebagai negara penganut sistem hukum Common Law. Penelitian ini bersifat yuridis normatif dan menyimpulkan bahwa terdapat persamaan dan perbedaan dalam pengaturan konsep ganti rugi di kedua negara. Hasil penelitian menunjukkan bahwa Australia memiliki pengaturan yang lebih jelas mengenai beberapa hal, seperti kapan ganti kerugian immateriil dapat diperhitungkan oleh pengadilan. Namun, Indonesia belum menerapkan doktrin mitigasi dalam perkara wanprestasi untuk membatasi ganti rugi. The research aims to compare contract law, particularly in the determination of damages due to default, in Indonesia and Australia as countries adhering to the Common Law legal system. This research is normative juridical in nature and concludes that there are similarities and differences in the regulation of the concept of compensation in both countries. The results show that Australia has a clearer regulation on several matters, such as when immaterial damages can be taken into account by the court. However, Indonesia has not yet applied the doctrine of mitigation in default cases to limit damages.”
