Abstract:

“ABSTRAK Penulisan artikel ini bertujuan agar pembaca dapat mengetahui dan menganalisa bahwa ketidakmampuan debitur yang mengalami Pemutusan Hubungan Kerja (PHK) akibat pandemi dalam memenuhi kewajibannya pada perjanjian kredit dengan Bank mengakibatkan wanprestasi dan bentuk perlindungan hukum bagi debitur yang mengalami Pemutusan Hubungan Kerja (PHK) akibat pandemi berkaitan dengan perjanjian kredit. Dalam penulisan jurnal ini, penulis menggunakan metode penelitian hukum normatif. Adapun hasil studi dari jurnal ini menunjukan bahwa ketidakmampuan debitur yang kehilangan pekerjaan pada masa pandemi akibat pemutusan hubungan kerja (PHK) dalam melaksanakan kewajibannya pada perjanjian kredit kemudian dianggap sebagai suatu tindakan wanprestasi, dan pemerintah berupaya memberikan perlindungan hukum bagi para pekerja yang mengalami PHK yang tercantum pada UU Ketenagakerjaan, PP Nomor 35 Tahun 2021 serta Peraturan Otoritas Jasa Keuangan No.11/POJK.03/2020, serta SE Nomor M/3/HK.04/III/2020. Kata Kunci: Pandemi Covid-19, Perlindungan Hukum, Pemutusan Hubungan Kerja, Debitur ABSTRACT The purpose of writing this article is so that readers can find out and analyze that the inability of debtors who experience Termination of Employment (PHK) due to the pandemic in fulfilling their obligations in credit agreements with the Bank results in default and forms of legal protection for debtors who experience Termination of Employment (PHK) due to the pandemic. with a credit agreement. In writing this journal, the author uses normative legal research methods. The results of the study from this journal show that the inability of debtors who lost their jobs during the pandemic due to termination of employment (PHK) in carrying out their obligations in the credit agreement is then considered an act of default, and the government seeks to provide legal protection for workers who have been laid off listed. in the Manpower Law, PP Number 35 of 2021 and Financial Services Authority Regulation No. 11/POJK.03/2020, and SE Number M/3/HK.04/III/2020.
