Abstract:

“Jurnal ilmiah ini bermaksud menunjukkan serta memahami legalitas metode omnibus dalam Pembentukan Peraturan Perundang-undangan pasca berlakunya Undang-Undang No. 13 Tahun 2022 dan mengkaji seberapa penting metode omnibus dalam membentuk undang-undang. Metode Penelitian yang diterapkan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konsep hukum. Hasil studi menunjukkan bahwa pengaturan metode omnibus pasca berlakunya UU No. 13 Tahun 2022 bahwa kedudukan metode omnibus telah legal digunakan dalam membentuk peraturan perundang-undangan sekaligus memberikan kepastian hukum bagi pembentuk dan pengguna undang-undang. Penggunaan metode omnibus dilakukan untuk penyederhanaan peraturan perundang-undangan yang tidak sedikit tumpeng tindih dan over regulated. This scientific research aims to show and understand the legality of the omnibus method in the formation of laws and regulations after the enactment of Law No. 13 of 2022 and examine how important the omnibus method is in forming laws. The research method used is a normative legal research method with a statutory approach and legal concepts. The results of the study show that the regulation of the omnibus method after the enactment of Law No. 13 of 2022 that the position of the omnibus method has been legally used in forming laws and regulations while providing legal certainty for law shapers and users. The use of the omnibus method is carried out to simplify overlapping laws and regulations.”
