Abstract:

“Penulisan artikel ilmiah ini mempunyai tujuan yakni mengkaji perlindungan hukum terhadap terhadap pencipta yang tidak mendapatkan pembayaran royalti dari aplikasi streaming musik. Metode penelitian yang digunakan adalah metode penelitian normative dengan pendekatan perundang-undangan dan deskriptif. Hasil dari pengakajian tersebut adalah bahwa pencipta mempunyai hak moral dan hak ekonomi terkait hasil ciptaanya. Ketika seorang pencipta tidak mendapatkan hak nya yang berupa royalti sebagai hak ekonominya maka perlindungan hukum yang diberikan dapat dilihat di UU Hak Cipta. Pencipta yang tidak mendapatkan royalti yang dimana merupakan haknya atas hasil ciptaanya guna melindungi hak-haknya berhak mendapat ganti kerugian akibat dirugikannya hak ekonominya yang mana tercantum dalam Pasal 96 UUHC. This study has some purpose which is to examine legal protection for creators who do not receive royalty payments from music streaming applications. This article writed by using normative legal research methods with statutory and descriptive approaches. Every study must have the result and the result shows us that creators have moral rights and economic rights regarding their creations. When a creator does not get his rights in the form of royalties as his economic rights, the legal protection provided can be seen in the Copyright Law. Creators who do not get royalties which are their rights over their creations in order to protect their rights are entitled to compensation due to loss of economic which is stipulated in article 96 of the copyright law.”
