Abstract:

“Tujuan penulisan ini untuk mengetahui pengaturan hukum sebagai kurir narkotika yang berlaku di Indonesia dan bagaimana pertanggungjawaban pidana kurir narkotika terkhusus jika subjeknya anak dibawah umur. Penelitian ini termasuk penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan fakta. Hasil dari penelitian, pemidanaan terhadap anak bisa dilakukan tetapi harus mengedepankan perlakuan terbaik terhadap anak tersebut. Dengan tidak mengesampingkan masa depan dari anak supaya dapat kembali kehidupan normalnya. Dalam proses kasus tindak pidana anak wajib berlandaskan asas ultimum remidium, yang mana sanksi pidana merupakan jalan terakhir penyelesaian kasus tindak pidana anak. The purpose of this writing is to find out the legal regulations for narcotics couriers that apply in Indonesia and what the criminal liability of narcotics couriers is, especially if the subject is a minor. This research includes normative legal research with a statutory approach and a factual approach. The results of the research show that punishment of children can be carried out but must prioritize the best treatment for the child. By not putting aside the child’s future so they can return to a normal life. In the process of child crime cases, it is mandatory to be based on the principle of ultimum remidium, where criminal sanctions are the last resort for resolving child crime cases.”
