Abstract:

“Artikel ilmiah ini bertujuan dalam mengkaji, memahami, dan mengevaluasi akibat hukum Notaris (bukan Pejabat Lelang Kelas II) pada pembuatan risalah lelang sesuai UU Jabatan Notaris. Penelitian ini menggunakan metode penelitian hukum normatif. Pengaturan Kewenangan Pembuatan Risalah Lelang Ditinjau Dari Undang-Undang Jabatan Notaris terdapat norma kabur yang terjadi pada Pasal 15 ayat (2) huruf g UUJN. Kekaburan norma dalam ilmu hukum bisa diselesaikan dengan menggunakan Teori Penafsiran Hukum yaitu Penafsiran Hukum Sistematis. Untuk memberikan kepastian hukum dalam pembuatan akta berita acara lelang, perlu dilakukan perubahan terhadap UUJN dengan menambahkan Pasal 15 ayat (2) huruf g yang menyebutkan bahwa Notaris harus terlebih dahulu diangkat sebagai Pejabat Lelang Kelas II oleh Pejabat Lelang Kelas II. Menteri Keuangan Republik Indonesia, terhadap Peraturan Lelang melalui proses legislasi di lembaga legislatif Indonesia, dalam hal ini DPR RI. Akibat hukum bagi Notaris yang membuat risalah lelang yang bukan termasuk Pejabat Lelang Kelas II yakni batal demi hukum akta risalah lelang, sebab melanggar syarat sahnya satu perjanjian sebagaimana diatur pada pasal 1320 KUHPerdata yaitu sah menurut hukum. sebab, sehingga apabila syarat-syarat tersebut tidak dipenuhi secara objektif, maka akan berakibat batal demi hukum. This scientific article aims to study, understand, and evaluate the legal consequences of a Notary (not a Class II Auction Officer) in the preparation of auction minutes in accordance with the Law on Notary Positions. This research uses normative legal research methods. Arrangement of Authority for Making Auction Minutes Judging from the Law on the Position of Notary, there is a vague norm that occurs in Article 15 paragraph (2) letter g of the UUJN. The obscurity of norms in legal science can be resolved by using the Theory of Legal Interpretation, namely Systematic Legal Interpretation. To provide legal certainty in the preparation of the auction minutes, it is necessary to amend the UUJN by adding Article 15 paragraph (2) letter g which states that a Notary must first be appointed as a Class II Auction Officer by a Class II Auction Officer. Minister of Finance of the Republic of Indonesia, against the Auction Regulations through the legislative process in the Indonesian legislative institutions, in this case the DPR RI. The legal consequence for a Notary who makes a minute of auction that is not a Class II Auction Officer is null and void the deed of auction minutes, because it violates the legal requirements of an agreement as regulated in Article 1320 of the Civil Code, which is legal by law. because, if these conditions are not met objectively, it will result in null and void.”
