USULAN PENGABAIAN HAK PATEN VAKSIN COVID-19 DALAM PERSPEKTIF HUKUM INTERNASIONAL

Abstract:

“Penulisan artikel ini bertujuan untuk mengetahui bagaimana pengaturan hukum paten internasional dalam bidang farmasi dan tinjauan hukum paten internasional terhadap usulan pengabaian hak paten vaksin COVID-19. Dalam penulisan jurnal ini menggunakan metode hukum normatif yang dilakukan dengan pendekatan peraturan instrumen hukum internasional (Statute Approach) dan pendekatan fakta-fakta yang ada. Adapun hasil studi dari penelitian ini adalah pengabaian hak paten Vaksin COVID-19 dinilai efektif untuk penyamarataan vaksin di seluruh dunia, khususnya pada negara berkembang apabila diiringi dengan usaha negara berkembang untuk melakukan penelitian dan pengembangan dari vaksin tanpa paten sehingga mereka dapat memproduksi vaksinnya sendiri dengan kemampuan yang ada dan hasil yang maksimal. The purpose of this article is to find out how international patent law regulates the pharmaceutical sector and reviewing the proposed COVID-19 vaccine waiver in international patent law. This journal is using the normative legal method which carried out with a regulatory approach to international legal instruments (Statute Approach) and factual phenomenon approach. The result of this study is the proposed COVID-19 vaccine patent waiver is considered as an effective way to leveling the vaccines throughout the world. This only can be realized if it is accompanied by the efforts of developing countries to conduct research and development of vaccines without patents so that they can produce their own vaccines with their ability and with a maximum results.”
