PERTANGGUNGJAWABAN PIDANA DOKTER TERHADAP KELALAIAN DALAM MEMBERIKAN PELAYANAN MEDIS SERTA URGENSI INFORMED CONSENT

Abstract:

“Tujuan studi ini adalah untuk mengkaji pertanggungjawaban pidana dokter terhadap kelalaian dalam memberikan pelayanan medis serta mengetahui urgensi informed consent. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa informed consent merupakan hal yang sangat penting diberikan kepada pasien sebelum dilakukannya tindakan medik dan apabila terjadi kelalaian medis dalam memberikan pelayanan medis, maka terhadap dokter yang melakukan kelalaian tersebut dapat dimintai pertanggungjawaban pidana sebagaimana tercantum dalam “Pasal 263, 267, 294 ayat (2), 299, 304, 322, 347, 348, 349, 351, 359, 360, 361, 531 Kitab UndangUndang Hukum Pidana.” The purpose of this study is to examine the criminal liability of doctors for negligence in providing medical services and to know the urgency of informed consent. This study uses a normative legal research method with a statutory and conceptual approach. The results of the study indicate that informed consent is very important given to patients before medical action is taken and if there is medical negligence in providing medical services, then the doctor who commits the negligence can be held criminally responsible as stated in “Article 263, 267, 294 paragraph (2), 299, 304, 322, 347, 348, 349, 351, 359, 360, 361, 531 of the Criminal Code.””
