Abstract:

“Fokus studi berupaya menelaah suatu upaya hukum yang dikenal dengan citizen lawsuit atau hak gugat warga negara yang dapat diaplikasikan ketika terdapat inkompetensi pemerintah Indonesia. Pengajuan tuntutan hak ini diadopsi dari sistem hukum common law. Salah satu inkompetensi pemerintah dapat dilihat pada masa munculnya pandemi COVID-19, utamanya melalui narasi-narasi dari beberapa pemimpin eksekutif Indonesia yang kurang antisipatif dan mitigatif. Berkaca dari hal tersebut, studi ini diperlukan untuk memberikan kepastian atas perlindungan hukum yang merugikan kesejahteraan umum atapun hak-hak warga negara kedepannya, salah satunya melalui gugatan instrumen citizen lawsuit terhadap langkah yang diambil pemerintah Indonesia ketika menanggulangi pandemi COVID-19. The main focus of this writing is to examine a legal mechanism known as citizen lawsuit upon the government incompetence. The filing of this claim is adopted under the common law system. Focusing on government incompetence was evident in handling the Covid-19 pandemic, particularly through the lack of anticipative and mitigative narratives conveyed by the executive leaders in Indonesian government. Reflecting on this, it would be imperative to provide protective regulations on citizen’s rights, including through citizen lawsuit on policies enacted by the government to handle the pandemic.”
