Abstract:

“Tujuan dari studi ini yaitu untuk mengkaji terkait hak dari Pemilik Hak Cipta karya sinematografi film dan mengkaji pengaturan hukum terhadap tindakan reviewer dari karya sinematografi mengacu pada hukum kekayaan intelektual khususnya hak cipta. Bentuk metode yang digunakan oleh penulis adalah peneilitian hukum normatif dengan penyusunan deskriptif melalui pendekatan perundang-undangan (statute approach) dan penekatan konseptual (conseptual approach). Hasil dari studi menunjukkan bahwa hak ekonomi Pemilik Hak Cipta diatur pada Pasal 8 UU Hak Cipta dan hak moral dari Pemilik Hak Cipta diatur pada Pasal 5 UU Hak Cipta. Mengenai tindakan reviewer film merupakan tindakan yang melanggar hak-hak Pemilik Hak Cipta dan dapat diselesaikan baik melalui gugatan ganti rugi sesuai Pasal 99 ayat (1) UU Hak Cipta dan juga melalui jalur pidana yang dimuat pada Pasal 113 ayat (3) UU Hak Cipta. The purpose of this study is to examine rights of the copyright owner of cinematographic film works and the legal assessment of the reviewer’s actions of cinematographic works referring to the law of intellectual property rights, especially rights. The methode implemented in this research is a descriptive normative method through a statute approach and conseptual. Results of the study shows that the economic rights of the copyright owner are regulated in Article 8 and the moral rights of the copyright owner are regulated in Article 5 of the Copyright Law. About film reviewer’s action is an act that violates the rights of the copyright owner and can be resolved properly through a claim for compensation in accordance with Article 99 paragraph (1) of the Copyright Law and also through criminal means as regulated in Article 113 paragraph (3) Copyright Act.”
