Abstract:

“Penelitian ini bertujuan untuk mengetahui pertanggungjawaban bank dan bentuk perlindungan hukum kepada nasabah bank akibat modus card skimming dalam perspektif PBI dan POJK. Metode penelitian yang digunakan yaitu normatif dengan pendekatan konseptual (Conceptual Approach) dan pendekatan perundang-undangan (Statute Approach). Hasil daripada penelitian ini, yang pertama yaitu bank bertanggungjawab terhadap nasabah sebagai Pengguna Jasa, dengan terlebih dahulu membuktikan bahwa hilangnya dana nasabah disebabkan oleh adanya card skimming. Maka sesuai dengan ketentuan Pasal 38 huruf c POJK Nomor 1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan, bank berkewajiban memberi ganti rugi apabila pengaduan nasabah terbukti benar. Akan tetapi jika terdapat unsur kelalaian dari nasabah, pihak bank tidak akan memberikan ganti rugi. Kemudian yang kedua, bentuk perlindungan hukum kepada nasabah bank yaitu perlindungan langsung dan tidak langsung diatur dalam Surat Edaran Bank Indonesia Nomor 14/17/DASP tentang Penyelenggaraan Kegiatan Alat Pembayaran dengan Menggunakan Kartu, Surat Edaran Bank Indonesia Nomor 17/52/DKSP tentang Implementasi Standar Nasional Teknologi Chip dan Penggunaan Personal Identification Number Online 6 Digit untuk Kartu ATM yang Diterbitkan di Indonesia, serta Pasal 2 Ayat (2) POJK Nomor 1/POJK.07/2014 tentang Lembaga Alternatif Penyelesaian Sengketa di Sektor Jasa Keuangan. This study aims to determine the liability of banks and forms of legal protection to bank customers due to card skimming mode in the perspective of PBI and POJK. The research method used is normative with a conceptual approach and a statutory approach. The results of this study, the first is that the bank is responsible for the customer as a Service User, by first proving that the loss of customer funds is caused by card skimming. So in accordance with the provisions of Article 38 letter c of POJK Number 1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sector, banks are obliged to provide compensation if customer complaints are proven to be true. However, if there is an element of negligence from the customer, the bank will not provide compensation. Then, the second form of legal protection for bank customers, namely direct and indirect protection, is regulated in Bank Indonesia Circular Letter Number 14/17/DASP concerning Implementation of Card-Based Payment Instrument Activities, Bank Indonesia Circular Letter Number 17/52/DKSP concerning Standard Implementation National Chip Technology and Use of 6-Digit Online Personal Identification Number for ATM Cards Issued in Indonesia, as well as Article 2 Paragraph (2) POJK Number 1/POJK.07/2014 concerning Alternative Dispute Resolution Institutions in the Financial Services Sector.”
