Abstract:

“Tujuan penulisan adalah untuk menambah pengetahuan tentang hubungan alat bukti elektronik dengan hukum acara pidana dan legalitas alat bukti elektronik dalam hukum acara pidana. Penulisan ini menggunakan metode penelitian hukum normatif disertai mengkaji legalitas alat bukti elektronik dalam hukum acara pidana, melalui menerapkan pendekatan perundangundangan dan pendekatan konseptual, serta mempergunakan bahan hukum primer, sekunder serta tersier lalu hasilnya dijabarkan dengan cara deskriptif. Hasil penelitian ditunjukkan bahwa alat bukti elektronik dapat di hubungkan dengan 2 (dua) alat bukti pada hokum acara pidana yaitu menurut Pasal 184 UU HAP, yakni pada alat bukti surat dan petunjuk. Alat bukti elektronik dapat dikategorikan menjadi surat dikarenakan hail cetaknya berupa tulisan dan dapat dibaca serta diraba. Alat bukti elektronik bisa dikategorikan sebagai petunjuk dikarenakan bukti petunjuk sekadar bisa diperolch dengan keterangan saksi, surat serta keterangan terdakwa, dan surat masuk dalam sumber untuk memperoleh petunjuk. Alat bukti elektronik diakui menjadi alat bukti yang sah berdasarkan pada hukum acara pidana, perihal tersebut dikualifikasikan ke dalam alat bukti yang dicantumkan pada UU HAP, serta dipertegas dalam UU ITE. Kata Kunci: legalitas, alat bukti elektronik, hukum acara pidana The purpose of writing is to increase knowledge about the relationship between electronic evidence and criminal procedural law and the legality of electronic evidence in criminal procedural law. This writing uses a normative legal research method by examining the validity of electronic evidence in criminal procedural law, by applying a statutory approach and a conceptual approach, and using primary, secondary and tertiary legal materials then the results are described descriptively. The results of the research show that electronic evidence can be linked to 2 (two) pieces of evidence in criminal procedural law, namely according to Article 184 of the HAP Law, namely on documentary evidence and evidence of instructions. Electronic evidence can be categorized as a letter because the print is in the form of writing and can be read and touched. Furthermore, because it can be categorized as a letter, it can become evidence of clues, this is because evidence of instructions can only be obtained with witness statements, letters and statements of the defendant, and letters entered in the source to obtain instructions. Evidence Electronic evidence is recognized as valid evidence in criminal procedural law, this is qualified into one of the evidence contained in the HAP Law, namely letter evidence and directive evidence as well as emphasized in the Law of the Republic of Indonesia Number 11 of 2008.
