Abstract:

“Studi ini bertujuan untuk mengetahui tanggungjawab pengusaha terhadap pekerja harian di Taman Nusa Gianyar serta mengakaji faktor penghambat dalam pemenuhan hak pekerja harian yang ada di Taman Nusa Gianyar. Metode dalam penulisan ini adalah hukum empiris dengan pendekatan fakta serta pendekatan perundang-undangan. Hasil studi menunjukkan bahwa perlindungan hukum yang diberikan oleh Taman Nusa terhadap pekerja harian lepas masih belum terpenuhi yaitu mengenai bahwa pekerja harian lepas tidak tercatat pada program BPJS dikarenakan adanya aspek-aspek penghalang antara lain faktor penegak hukum dan faktor masyarakat. Maka pengusaha diharapkan lebih mengoptimalkan perlindungan yang diberikan terhadap pekerja harian lepas dengan mendaftarkan pada program BPJS dan memberikan sosialisasi tentang hak-hak pekerja sebagaimana yang tercantum di dalam undang-undang. This study aims to determine the responsibilities of employers towards daily workers in Taman Nusa Gianyar and to assess the inhibiting factors in fulfilling the rights of daily workers in Taman Nusa Gianyar. The method in this writing is empirical law with a factual approach and a statutory approach. The results of the study show that the legal protection provided by Taman Nusa for casual daily workers is still not fulfilled, namely regarding that casual daily workers are not registered in the BPJS program due to barrier aspects, including law enforcement and community factors. So employers are expected to further optimize the protection provided to casual daily workers by registering with the BPJS program and providing socialization about workers rights as stated in the law.
