Abstract:

“Studi ini bertujuan untuk mengetahui dan menganalisis terkait pengaturan hak cipta atas penggunaan nama artis pada karya sastra di aplikasi wattpad dan bentuk perlindungan hukum hak cipta terhadap artis yang digunakan namanya dalam karya sastra di aplikasi wattpad. Penulisan karya ilmiah ini menggunakan jenis penelitian normatif. Tulisan ini menggunakan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Hasil studi menunjukkan bahwa pengaturan hak cipta atas penggunaan nama artis pada karya sastra di aplikasi wattpad Pasal 40 huruf a Undang-Undang No. 28 Tahun 2014 Tentang Hak Cipta dijelaskan bahwa karya sastra di aplikasi wattpad termasuk kedalam lingkup karya tulis lainnya, pengaturan penggunaan nama artis dalam karya sastra di aplikasi wattpad tidak secara jelas diatur dalam Undang-Undang No. 28 Tahun 2014 Tentang Hak Cipta. Bentuk perlindungan hukum hak cipta terhadap artis yang digunakan namanya dalam karya sastra di aplikasi wattpad yaitu bentuk perlindungan hukum preventif yaitu dengan membuat perjanjian lisensi dan bentuk perlindungan hukum represif di mana lebih ditujukan dalam penyelesaian sengketa. The results of the study show that the regulation of copyright for the use of artist names in literary works in the Wattpad application Article 40 letter a of Law no. 28 of 2014 concerning Copyrights, it is explained that literary works in the wattpad application are included in the scope of other written works, the regulation of the use of artist names in literary works in the wattpad application is not clearly regulated in Law no. 28 of 2014 concerning Copyright. The form of copyright legal protection for artists whose names are used in literary works in the Wattpad application is a form of preventive legal protection, namely by making a license agreement and a form of repressive legal protection which is more aimed at resolving disputes.
