TANGGUNG JAWAB PENGURUS KOPERASI TERHADAP PEMBUBARAN KOPERASI YANG DINYATAKAN PAILIT

Abstract:
“ABSTRAK Studi ini bertujuan untuk memahami akibat hukum pembubaran koperasi yang dinyatakanpailit terhadap pengurus koperasi, selain itu juga pada tulisan ini juga akan membahas lebihlanjut terkait tanggung jawab pengurus koperasi terhadap pembubaran koperasi yangdinyatakan pailit. Adapun metode yang digunakan dalam studi ini adalah metode penelitianhukum normatif dengan pendekatan konsep dan pendekatan perundang-undangan. sumberyang diambil berasal dari bahan hukum primer dan bahan hukum sekunder. Hasil studi inimenunjukkan bahwa koperasi yang dinyatakan pailit karena berada dalam keadaan hartakekayaannya pada sita umum, koperasi dinyatakan bubar dapat diputus berdasarkan ataskeputusan rapat anggota dan keputusan pemerintah. Terdapat akibat hukum yang diperolehpengurus koperasi atas bubarnya koperasi yang dinyatakan pailit memiliki hal yangmembedakan, pembubaran koperasi yang disepakati melalui rapat anggota, pengurus memilikikekuasaan yang masih berlaku dalam menyelesaikan pembubaran, lain halnya padapembubaran koperasi yang disepakati melalui keputusan pemerintah, sudah tidak adanyakekuasaan dari pengurus dalam menyelesaikan pembubaran. Pengurus koperasi bertanggungjawab atas koperasi yang akan melakukan pembubaran karena dinyatakan pailit, penguruskoperasi secara perorangan maupun bersama-sama bertanggung jawab atas kerugian darikoperasi, jika pengurus koperasi terbukti dalam dalam menjalankan tugasnya melakukankesengajaan atau kelalaian, pengurus koperasi yang dengan sengaja melakukan tindakan yangmenyebabkan kerugian pada koperasi juga dapat dituntut ke pengadilan. Kata Kunci: Tanggung Jawab, Pembubaran, Pengurus, Koperasi, Pailit. The method used in this study is a normative legalresearch method with a conceptual approach and a statutory approach. The sources taken are fromprimary legal materials and secondary legal materials. The results of this study indicate that cooperativesthat are declared bankrupt because their assets are in general confiscation, cooperatives declareddisbanded can be terminated based on the decisions of members’ meetings and government decisions.There are legal consequences obtained by the management of the cooperative for the dissolution of acooperative that is declared bankrupt has different things, the dissolution of the cooperative which wasagreed upon through a member meeting, the management has the power that is still valid in completingthe dissolution, it is different in the case of the dissolution of the cooperative which was agreed uponthrough a government decision, there is no longer any the power of the board of directors in completingthe dissolution. The management of the cooperative is responsible for the cooperative that will be dissolvedbecause it is declared bankrupt, the management of the cooperative individually or jointly is responsiblefor the loss of the cooperative, if the cooperative management is proven in carrying out his dutiesintentionally or negligently, the cooperative management who deliberately takes actions that causinglosses to the cooperative can also be sued in court.
