Abstract:

“Tujuan artikel ini untuk mengkaji kepastian hukum dalam pertanggungjawaban pelaku tindak pidana penyebaran berita hoax di media sosial pada masa pandemi. Penulisan artikel ini menggunakan metode penelitian normatif yang mengkaji dari dokumen-dokumen yakni menggunakan data skunder yang diperoleh dari peraturan perundang-undangan, teori hukum serta doktrinasi pakar hukum. Hasil studi merumuskan kepastian hukum bagi pelaku penyebaran berita bohong dapat dijerat dalam pasal 28 ayat 1 UU No.19 tahun 2016 tentang informasi dan transaksi elektronik atas perbuatan dengan sengaja menyebarkan atau menyesatkan berita palsu yang menimbulkan kekacauan. Ditinjau dari perspektif hukum UU No. 19 tahun 2016 belum sepenuhnya memenuhi aspek keadilan yang disebabkan UU ini hanya menjerat bagi pelaku pengguna media sosial saja tidak teruntuk bagi pemilik aplikasi media sosial tersebut. Tidak menutup kemungkinan itu terjadi pada pemilik aplikasi dalam melakukan aksi penyebaran hoax. The purpose of this article to examine legal certainty in the accountability of the actors of the US deposit of hoax news in social media in pandemic. This arttel writing uses normative research methods that review the documents using data skuncarments obtained from legislation, legal theory and doctrine of the low. The results of the study formulating legal certainty for the deployment of the lie of news lie a dramalated in article 28 paragraph 1 of the law No. 19 of 2016 on electronic information and transactions on deeds deployed or misleading fake news that caused chaos. View from the law perpective of law No. 19 years 2016 has not fully fulfilling the aspects of justice caused by this law only to smell for social media users only not touched for the owner of the social media applications. It does not close that it happens to the applications owner in doing the hoax spreading action.”
