Abstract:

“Tujuan penelitin ini untuk mengetahui pelaksana tugas sementara gubernur memiliki wewenang yang terbatas. Artinya ia tak memiliki wewenang yang sama dengan jabatan yang diembannya untuk sementara karena ada aturan-aturan yang membatasinya. Berawal dari adanya konflik normatif, penelitian ini menggunakan penelitian hukum normatif dalam pendekatan pengadilan, konseptual, komparatif, dan studi kasus. Sumber hukum penelitian ini meliputi dokumen hukum primer dan sekunder yang dikumpulkan dengan teknik bola salju. Teknik yang digunakan untuk menganalisis dokumen hukum adalah teknik penjelasan, sistematisasi, komposisi, dan penalaran. Hasil penelitian ini menunjukan bahwa Wewenang pelaksana tugas sementara gubernur tidak sama dengan gubernur karena ada beberapa hal yang tidak bisa dilakukan oleh pelaksana tugas sementara gubernur sesuai dengan aturan yang ada di dalam undang-undang dan mekanisme penyusunan anggaran pendapatan dan belanja daerah harus sesuai dengan Pasal 186 undang-undang nomor 32 tahun 2004 tentang keuangan Negara. Kata Kunci: Kewenangan, Pelaksana Tugas Sementara, Anggaran Pendapatan Dan Belanja Daerah ABSTRACT The purpose of this research is to find out the temporary governor has limited authority. This means that he does not have the same authority as the position he held for a while because there are rules that limit him. Departing from the existence of a conflict of norms, this research uses normative legal research with a statutory, conceptual, comparative and case approach. The sources of legal materials in this study consist of primary and secondary legal materials collected using the snowball technique. The technique of analyzing legal materials used is the technique of description, systematization, construction and argumentation. The results of this study indicate that the authority of the governor’s interim task force is not the same as the governor’s because there are several things that the governor’s interim task force cannot do in accordance with the rules contained in the law and the mechanism for preparing regional revenue and expenditure budgets must be in accordance with Article 186 Law No. 32 of 2004 concerning State Finance.
