Abstract:

“Tujuan dari penulisan artikel ini untuk mengetahui dan menganalisis tentang peran KemKominfo terhadap pembajakan film pada situs streaming film ilegal serta mengidentifikasi sanksi hukum dari penyebarluasan film pada situs streaming film tersebut. Metode penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif yaitu dengan mengkaji Peraturan Perundang-undangan dan bahan literatur yang berkaitan dengan pokok bahasan dengan analisis konsep hukum. Hasil studi menunjukan, berdasarkan Pasal 56 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, KemKominfo memiliki wewenang dalam penutupan konten dan/atau hak akses pengguna yang melanggar Hak Cipta di Internet. Wewenang KemKominfo untuk menumpas pelanggaran Hak Cipta di Internet, seperti menutup hak akses pada situs streaming film ilegal diatur dalam Peraturan Menteri Komunikasi dan Informatika Nomor 26 Tahun 2015 tentang Pelaksanaan Penutupan Konten dan/atau Hak Akses Pengguna Pelanggaran Hak Cipta dan/atau Hak Terkait dalam Sistem Elektronik. Terkait sanksi hukum yang diberikan jika melanggar Hak Cipta, seperti menyebarkan film melalui situs streaming film ilegal diatur pada Pasal 113 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. The research method used in this paper is normative legal research, namely by reviewing the legislation and literature related to the subject with an analysis of legal concepts. The results of the study show, based on Pasal 56 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, the Ministry of Communication and Information has the authority to close content and/or access rights of users who violate Copyright on the Internet. The authority of the Ministry of Communication and Informatics to suppress Copyright infringement on the Internet, such as closing access rights to illegal film streaming sites is regulated in the Peraturan Menteri Komunikasi dan Informatika Nomor 26 Tahun 2015 tentang Pelaksanaan Penutupan Konten dan/atau Hak Akses Pengguna Pelanggaran Hak Cipta dan/atau Hak Terkait dalam Sistem Elektronik.
