Abstract:
“Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang pandemi Corona Virus Disease (SARS-CoV-2) - COVID-19 sebagai keadaan force majeure dalam suatu kontrak bisnis dan sekaligus berpotensi menjadi pengahambat pelaksanaan kontrak bisnis. Penelitian ini tergolong penelitian normatif yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pandemi COVID-19 memenuhi unsur-unsur keadaan force majeure. Mengingat COVID-19 merupakan peristiwa yang tidak dapat diprediksi dan turut berimplikasi pada ketidakmampuan pihak dalam melaksanakan isi kontrak. Namun demikian, Pandemi COVID-19 tidak serta merta dapat dijadikan alasan force majeure yang berimplikasi pada ketidakmampuan melaksanakan isi perjanjian. Oleh karenanya dibutuhkan upaya pembuktian terhadap pandemi COVID-19 yang dapat dikualifikasi sebaga peristiwa force majeure. Kata kunci: COVID-19, Force Majeure, Kontrak Bisnis ABSTRACT This study aims to determine and analyze the Corona Virus Disease (SARS-CoV-2) - COVID-19 pandemic as a force majeure situation in a business contract and at the same time has the potential to become an obstacle to the implementation of business contracts. This research is classified as a normative research that uses a statutory approach and a conceptual approach. The results show that the COVID-19 pandemic fulfills the elements of a force majeure situation. Given that COVID-19 is an unpredictable event and also has implications for the inability of parties to carry out the contents of the contract. However, the COVID-19 pandemic cannot automatically be used as an excuse for force majeure which implies the inability to carry out the contents of the agreement. Therefore, an effort to prove the COVID-19 pandemic is needed that can qualify as a force majeure event. Keywords: COVID-19, Force Majeure, Business Contract”
