Abstract:
“Artikel ini bertujuan untuk mengetahui dan menganalisis tentang pengaturan intervensi dalam hukum internasional serta mengetahui dan menganalisis tentang kedudukan Vanuatu dalam memberikan intervensi terhadap Indonesia melalui Organisasi Papua Merdeka (OPM). Artikel ini tergolong metode penelitian hukum normatif yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil analisis, diketahui bahwa tidak terdapat pengaturan terkait intervensi dalam hukum internasional karena alasan prinsip Non-Intervention yang diatur dalam the Charter of United Nation (C.UN). Namun prinsip tersebut telah mengalami pergeseran dengan ditenggarai oleh dukungan Chapter VII (39-51) C.UN maka dibentuk ICIS- Kanada dengan maksud “the responsibilty to protect”. Adapun kedudukan Vanuatu dalam memberikan intervensi terhadap Indonesia melalui Organisasi Papua Merdeka (OPM) dinilai cacat hukum, mengingat tidak terdapat pengaturan hukum internasional yang mengakui adanya potensi untuk melaksanakan intervensi dari gerakan separatisme seperti halnya OPM. Kata Kunci: Vanuatu, Intervensi, Sengketa Kemerdekaan ABSTRACT This article aims to identify and analyze intervention arrangements in international law as well as to find out and analyze Vanuatu’s position in intervening against Indonesia through the Free Papua Organization (OPM). This article is classified as a normative legal research method that uses a statutory approach and a conceptual approach. Based on the results of the analysis, it is known that there are no regulations related to intervention in international law due to the principle of Non-Intervention which is regulated in the Charter of United Nation (C.UN). However, this principle has shifted with the support of Chapter VII (39-51) C.UN, so that ICIS-Canada was formed with the intention of “the responsibilty to protect”. As for Vanuatu’s position in intervening against Indonesia through the Free Papua Organization (OPM), it is considered legally flawed, considering that there are no international legal arrangements that recognize the potential to carry out interventions from separatist movements such as OPM.
