Abstract:

“Sebagai pengertiannya memiliki barang dari hasil tindak kejahatan untuk mendapatkan uang atau keuntungan pribadi lainya, maka dari itu masalah yang dibahas dalam jurnal ini menganalisis peranan pasal 480 KUHP tentang penadahan barang oleh oknum penegak hukum kepada pembeli atau pemilik barang dari hasil kejahatan serta mempertimbangkan keputusan hakim untuk menetukan sanksi terhadap pelaku penadahan barang dari hasil kejahatan. Penulis mengambil metode penelitin hukum empiris, suatu bentuk penulisan hukum mendasarkan kepada teori hukum terkait, literatur serta peraturan perundang-undangan yang masih berlaku serta beberapa informasi dari penegak hukum dalam Pengadilan mengenai sistem hukum pasal 480 tentang penadahan. Penerapan dalam pasal 480 KUHP menurut para penegak hukum dilakukan dengan kepastian terpenuhinya unsur penadahan kepada pelaku dengan penyidikan untuk menemukan bukti yang cukup dalam penerapan pasal 480 KUHP, serta menentukan sanksi dan pertanggungjawaban pelaku sebagai pelaku penadahan, hakim menentukan dan menunjukkan bukti dalam persidangan untuk menentukan penilaian guna memperoleh petunjuk untuk menguatkan keyakinan hakim dalam memberikan sanksi pelaku dalam kasus penadahan barang dari hasil kejahatan. Kata Kunci ; Penadahan Barang, Sanksi Hakim, Pembelian Barang Kejahatan ABSTRACT As a sense of possessing goods from crimes for money of other personal benefits, therefore the issue discussed in this journal analyzes the role of 480 code about breeding courtesy of law enforcement to the purchaser or owner of the goods from the crime and to consider the judges dicsion to sanction perpetrators of tha crim.The author takes juridical research methods, a from of law writing based on legal theories, current literature and regulations and some information from law enfocement in the courts on the legal system chapters 480 code about breeding application in chapters 480 code according to law enforcement, it was determined to ensure the compliance of the implanting elements to the perpetrator of a probe to find sufficient evidence for application to chapters 480 code, and authorizing the sanction and accountability of the perpetrators of the fence, which judges determine and presnt evidence in court for determining assessments to obtain guidelines for starngthening the judge’s confidence in sanctioning the perpetrators of the criminal accounting.
