Abstract:

“Artikel ini bertujuan untuk mengetahui dan menganalisis tentang perbandingan hukum antara Indonesia dan Malaysia mengenai pengaturan hukum tentang quid pro quo. Artikel ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan. Analisis bahan hukum dalam artikel ini menggunakan teknik analisis kualitatif yang melakukan interpretasi hukum dengan menggunakan logika induktif yang dituangkan dalam uraian deskripsi. Berdasarkan hasil analisis, diketahui bahwa hukum di Indonesia dan hukum di Malaysia sama-sama memiliki pengaturan tentang quid pro quo yang dikualifikasi sebagai kejahatan kesusilaan. Namun demikian, terdapat keunggulan dari hukum Malaysia yang mengatur tentang penjatuhan sanski berupa denda terhadap perusahaan yang tidak kooperatif dalam menyelesaikan permasalahan quid pro quo yang terjadi di internal perusahaannya. Penerapan denda sebagaimana dimaksud, hendaknya dapat diterapkan di Indonesia guna lebih menjamin upaya penegakan hukum terhadap permasalahan quid pro quo. The analysis of legal materials in this article uses qualitative analysis techniques that interpret the law by using inductive logic as outlined in the description description. Based on the analysis, It is known that the law in Indonesia and the law in Malaysia both have provisions regarding quid pro quo which qualify as a crime of decency. However, there is an advantage of Malaysian law which regulates the imposition of sanctions in the form of fine towards companies that are not cooperative in resolving quid pro quo problems that occur internally. The application of the fines as intended, should be applicable in Indonesia in order to better guarantee law enforcement efforts against quid pro quo issues.
