Abstract:

“Tujuan dari dari penulisan artikel ini, yaitu: (1) untuk mengetahui dan menganlisis tentang legalitas perang dalam pandangan hukum humaniter internasional; dan (2) untuk mengetahui dan menganlisis tentang tinjauan hukum humaniter dalam melihat aksi penyerangan koalisi Arab Saudi terhadap Yaman dalam prespektif hukum humaniter. Artikel ini tergolong penelitian hukum normatif yang menggunakan 2 jenis pendekatan, yaitu pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil analisis, maka dapat disimpulkan bahwa perang yang dipandang legal menurut hukum humaniter ialah perang yang pelaksanaannya bersesuaian dengan Konvensi Jenewa dan Kovensi Den Haag. Memperhatikan aksi penyerangan koalisis arab Saudi terhadap Yaman, maka penyerangan sebagaimana dimaksud sangat bertentangan Protokol Tambahan Konvensi Jenewa 1947. Kata Kunci: Penyerangan, Militer Koalisi, Hukum Humaniter ABSTRACT The purposes of this article are: (1) to identify and analyze the legality of war in the view of international humanitarian law; and (2) to find out and analyze the review of humanitarian law in seeing the actions of the Saudi Arabian coalition’s attack on Yemen from a humanitarian law perspective. This article is classified as normative legal research that uses 2 types of approaches, namely the statutory approach and the conceptual approach. Based on the results of the analysis, it can be concluded that a war which is considered legal according to humanitarian law is a war whose implementation is in accordance with the Geneva Conventions and the Hague Conventions. Taking into account the actions of the Saudi Arabian coalition’s attack on Yemen, the attack as referred to strongly contradicts the Additional Protocol to the 1947 Geneva Convention.
