Abstract:

“Tujuan penulisan artikel jurnal ini untuk mengetahui dan menganalisis tentang penyebab kelalaian, upaya pencegahan dan perlindungan hukum oleh JNE Kediri-Tabanan kepada konsumennya yang mengalami kerugian akibat kelalaian dalam pengiriman. Penulisan ini menggunakan metode penelitian hukum empiris, yang menggunakan teknik pengumpulan data berupa wawancara dan pengamatan atau observasi. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa (!) faktor penyebab terjadinya kelalaian pada JNE karena kurangnya pegawai di saat sedang ramai, (2) upaya pencegahan dengan melakukan 4 oprasional yaitu collecting, transporting, processing, delivery, (3) perlindungan bagi konsumen yang mengalami kerugian akibat kelalaian dalam pengiriman adalah berupa kompensasi ganti rugi oleh penyedia jasa ekspedisi. This writing uses empirical legal research methods, which use data collection techniques in the form of interviews and observations. Based on the results of research and discussion it can be concluded that (!) The factors causing negligence in JNE due to lack of employees when it is busy, (2) prevention efforts by conducting 4 operational namely collecting, transporting, processing, delivery, (3) protection for consumers who incur losses due to negligence in shipping in the form of compensation for compensation by the expedition service provider.
