Abstract:

“Dalam kegiatan usaha jasa cuci mobil terkadang adanya pelaku usaha yang melakukan kelalaian yang mengakibatkan kerugian terhadap konsumen. Tujuan penulisan jurnal ini untuk mengkaji dan memahami kepastian hukum khususnya pada hukum perlindungan konsumen dan tanggung jawab pelayanan pelaku usaha terkait pemenuhan hak konsumen bagi yang mengalami kerugian. Penulisan jurnal ini menggunakan metode penelitian hukum empiris dengan pendekatan fakta dan perundang-undangan. Hasil dari penelitian yang telah dilaksanakan dapat disimpulkan bahwa jasa cuci mobil di Kuta Selatan telah bertanggung jawab dalam hal pemenuhan hak konsumen apabila terdapat kelalaian pelaku usaha yang mengakibatkan kerugian terhadap konsumennya, sehingga telah sesuai dengan Pasal 19 Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Kata Kunci: Perlindungan Konsumen, Tanggung Jawab, Usaha Jasa Cuci Mobil Abstact In carwash service business activity, businessmen sometimes make mistakes that can harm consumer. The purpose of this study is to examine and comprehend the legal certainty especially consumer protection law and service responsibilities of businessmen related to the fulfillment of right for consumers who experience losses. This study uses a empirical legal research method with a fact approach and statute approach. The study shows that based on the research has been done, it can be known that car wash service businessmen in South Kuta have been responsible in term there’s loss that is suffered by consumer using that business, in line with article 19 Law Number 19 Year 1999 on Consumer Protection.
