Abstract:

“Tujuan tulisan ini adalah guna mengetahui dan mengkritisi perkembangan terorisme sebagai kejahatan lintas batas negara (kejahatan transnasional). Penelitian ini menggunakan jenis penelitian hukum normatif, dengan pendekatan perundang-undangan dan pendekatan fakta, ditunjang dengan sumber bahan hukum primer berupa perundang-undangan terkait dengan terorisme, sedangkan bahan hukum sekunder berupa buku-buku, jurnal-jurnal, hasil seminar, media cetak seperti surat kabar. Hasil penulisan disimpulkan bahwa ISIS sudah memenuhi semua kualifikasi untuk dikategorikan sebagai organisasi teroris yang terorganisir dan eks WNI ISIS yang menjadi FTF (Foreign Terrorist Fighter) telah kehilangan status kewarganegaraannya berdasarkan Pasal 23 ayat (1) huruf d Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan. The purpose of this paper is to understand and criticize the development of terrorism as a transnational crime. This research uses normative legal research, with a statute approach and a fact approach, supported by a source of primary legal material in the form of legislation related to terrorism, while secondary legal material in the form of books, journals, seminar results, print media such as newspapers. The writing results concluded that ISIS had fulfilled all qualifications to be categorized as an organized terrorist organization and former ISIS citizens who became FTF (Foreign Terrorist Fighter) had lost their citizenship status based on Article 23 paragraph (1) letter d of Law Number 12 of 2006 concerning Citizenship.”
