Abstract:

“ABSTRAK Penulisan artikel ini bertujuan untuk mengidentifikasi bentuk perlindungan konsumen berkaitan dengan penjualan hand sanitizer yang dikemas ulang tanpa izin edar, serta untuk mengetahui pertanggungjawaban pelaku usaha selaku penjual hand sanitizer yang dikemas ulang tanpa izin edar. Metode penelitian hukum normatif digunakan untuk mengidentifikasi bagaimana pengaturan hukum terkait ketentuan izin edar dalam perspektif hukum perlindungan konsumen. Jenis pendekatan yang digunakan dalam penulisan artikel ini adalah pendekatan analisis bahan hukum berupa peraturan perundang- undangan (statute approach) dan pendekatan analisa konsep hukum (analytical and conceptual approach). Adapun hasil yang dicapai dari penelitian ini adalah Pelaku usaha yang memperdagangkan hand sanitizer tanpa izin edar, telah melanggar hak-hak konsumen sehingga konsumen berhak untuk menuntut haknya melalui proses ganti rugi, kompensasi, dan/atau rehabilitasi. Pelaku usaha selaku penjual juga dapat dibebankan bentuk sanksi lain, berupa sanksi administratif dan sanksi pidana di dalam Undang-Undang Perlindungan Konsumen. Kata Kunci: Perlindungan hukum, Konsumen, Izin. ABSTRACT The writing of this article aims to identify legal protection for consumers, due to repackaged hand sanitizers selling as well as to find out the sellers responsibility due to hand sanitizers repackaged that sold without marketing authorization. Normative legal research method is used to identify the legal arrangements related to the provisions of the marketing authorization according to Indonesian consumer protection law. The type of approach used in writing this article is statute approach which analizing legal materials in the form of statutory regulations and analytical and conceptual approach of legal concept. The results achieved from this research are the sellers who sell the hand sanitizers without marketing authorization, have violated the rights of consumers, so the consumers have the right to claim their rights through compensation, and / or rehabilitation processes. Sellers may also be subject to other sanctions, such as criminal sanctions and administrative sanctions, in written in the “Consumer Protection Act”.
