Abstract:

“The purpose of this study is to explore land consolidation arrangements in Bali and explore in depth the transformation of Tri Hita Karana in land consolidation arrangements in Bali. This research method uses normative legal research. The approach used is the statutory approach, the concept approach and the facts approach. The sources of legal materials in this study are primary, secondary and tertiary legal materials. The result of this research is that land consolidation arrangements in Bali must still refer to the Bali RTRWP Regional Regulation and the Regulation of the Head of the National Land Agency Number 4 of 1991 concerning Land Consolidation. In relation to the transformation of Tri Hita Karana, the regulation of land consolidation in the BPN regulation must pay attention to the philosophical values ??adopted by the community in each region. Thus, land consolidation in Bali is inspired by Tri Hita Karana. Tujuan penelitian ini adalah untuk menelusuri pelaksanaan konsolidasi tanah di Bali dan menelusuri secara mendalam tentang transformasi Tri Hita Karana dalam pelaksanaan konsolidasi tanah di Bali. Metode penelitian ini menggunakan jenis penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan konsep dan pendekatan fakta. Adapun sumber bahan hukum dalam penelitian ini adalah bahan hukum primer, sekunder dan tersier. Hasil penelitian ini adalah pelaksanaan konsolidasi tanah di Bali harus tetap mengacu pada Perda RTRWP Bali dan Peraturan Kepala Badan Pertanahan Nasional Nomor 12 Tahun 2019 tentang Konsolidasi Tanah. Terkait dengan transformasi Tri Hita Karana, maka pelaksanaan konsolidasi tanah dalam peraturan BPN tersebut wajib memperhatikan nilai falsafah yang dianut oleh masyarakat di masing-masing daerah. Dengan demikian, konsolidasi tanah di Bali dijiwai oleh Tri Hita Karana.”
